Terms & Conditions

These apply when you book and stay with us at Padre Burgos Castle Resort.

Contract

A contract will come into existence between Padre Burgos Castle Resort (PBCR, we, us) and the Client when we receive your on-line booking or signed booking form along with your full deposit or valid credit card details. By making an on-line booking or signing and returning this booking form and/or paying the deposit or providing your valid credit card details you are accepting these conditions on behalf of all party members.

Booking & Payment

A provisional reservation is made by phone, by e-mail or via our on-line booking system and valid credit card (not debit card) details are required to secure the reservation. The reservation will only be confirmed once we have received the credit card details and have successfully performed an authorization check thereon and/or we have received a completed and signed Booking Form at which time a confirmation e-mail will be issued. We request that you read carefully the confirmation e-mail and contact us immediately if there are any errors as it may be difficult to rectify them later. Bookings apply to the declared number of party members only. If your party is larger than declared at the time of booking, or bookings for children are taken by adults, then accommodation for the additional party members and/or adults will be provided at PBCR’s sole discretion and extra charges will apply. Payment is made upon departure in Philippine pesos either by cash or credit card, and we also accept major currencies such as US$, C$, A$, S$, JPY, GBP and Euros. If you prefer not to use a credit card, a deposit of 10% of the total holiday cost is required to secure the reservation, with the balance, including transfers, ferry tickets, etc. payable 30 days before scheduled arrival date. Deposits and balance payments can be made via PayPal or by transfers into our Philippine bank account with all charges being borne by the Client.

Prices

Unless explicitly stated otherwise, all prices shown on our website, in the resort and in written and oral communications include 12% Philippine value added tax (VAT), but do not include a service fee of 10%, which applies to all items apart from food and beverage. Should the VAT rate change at any time, VAT will be payable at the rate effective at the time payment is made.

Liability

We do not accept liability for the actions or omissions of those involved in the holiday arrangements over whom we have no direct control and/or who are not employed by PBCR either as servants or agents. This includes but is not limited to persons providing services namely, airlines, bus companies, ferry operators, scuba diving instructors, dive masters, dive guides, whale shark guides, whale shark spotters, taxi operators, the owners or operators of any vehicle, aircraft, boat or equipment or any of their proprietors or employees. Whilst we make every effort to maintain properly our own equipment and use reliable providers, services such as internet access, mobile telephone networks, and electricity are provided by third parties and we do not guarantee availability of these or similar services and we do not accept liability in the event of unavailability.

Insurance

Although it is not obligatory we strongly recommend having adequate travel insurance. We do not have insurance for our clients or their property, and we do not accept responsibility for items which are lost, damaged or stolen.

Accuracy of Information

We take great care to ensure the accuracy of all information on our website or supplied in writing, by e-mail or given over the phone. Errors in general descriptions do occasionally occur and are by their nature subjective. Photos are there to give a general impression; articles of furniture, etc. could be changed or removed completely, and the sand on the inter-tidal area at the beach changes naturally on a daily basis. If any feature is important then you should contact us before reserving.

Your Liability

You undertake to behave with propriety and in such a manner as to in no way cause distress, damage, danger or injury to other clients, property, our employees and/or any third party. The contract of any client found in breach of this clause shall be terminated immediately and we shall have no further contractual obligation. We shall be entitled to recover the full cost of any damage or loss caused by you or your party.

Cancellations

If the reservation was made through an on-line reservation system or by completing a booking form, the cancellation conditions on the system/booking form will apply. In the case of on-line bookings, any cancellation should be processed through the system and if you completed a booking form you should notify us of your cancellation by e-mail. In other cases, such as booking by phone or e-mail, cancellations made more than 30 days before scheduled arrival date will incur a cancellation fee of 10% of the total holiday cost which will be charged against the credit card used to secure the reservation. In the case of part cancellation, the amount payable will be proportionate to the number of cancelled nights. In the event of a ‘no-show’ or a cancellation or part cancellation less than 30 days before scheduled arrival date, the full charge for the rooms, in-bound transfers and any pre-purchased ferry tickets will be due and charged to the credit card. In all cases, ‘no shows’ will incur a 100% cancellation fee and the room(s) reserved will be made available for other bookings. If the booking was secured by making a deposit, and the balance is not paid in full by the due date, the reservation will be deemed to be cancelled and the deposit paid will be forfeited.

Scuba Diving

The standard daily scuba diving programme is 2 morning dives departing at 8.30am and 1 afternoon dive departing at 2.30pm, or at such other times as notified in advance, and it is your responsibility to be ready to depart at those times. If bad weather or other operational problems force cancellation or curtailment of this programme, and you have undertaken all the standard dives available during the period of your stay (2 dives each morning and 1 dive each afternoon), then no charge will be made for any pre-booked dives you were unable to undertake as a result of such bad weather or operational problems. Guests who have booked a 3-dive-per-day package may substitute a Whale Shark Tour for a full day’s diving, otherwise a Whale Shark Tour can be undertaken in lieu of 2 pre-booked dives and a credit of 2 times the applicable single diving rate will be given against the prevailing cost of the Whale Shark Tour. Additional dives, such as night dives, will also be credited against the pre-booked dives. In all other circumstances, you will be liable for the cost of the full number of dives which were pre-booked, plus any dives undertaken in excess of the number of pre-booked dives. Furthermore, and irrespective of whether your diving was booked in advance of arrival or on site, if you cancel any of the dives part-way through any particular diving outing, you will be liable for the cost of all the dives planned for that outing – for example, if you cancel the 2nd dive on a 2-dive morning trip you will be charged as if you had undertaken both dives. If you need to rent diving equipment (other than tanks and weights) you must inform us of your requirements at the time of booking. You will be liable for the cost of any pre-booked dives missed as a result of non-availability of rental equipment which was not pre-booked, or failure or loss of your own personal diving equipment.

Whale Shark Tours

Whale Shark Tours depart at 7.30am, or at such other times as notified in advance, and it is your responsibility to be ready to depart at those times. If bad weather makes it unsafe to conduct a Whale Shark Tour or other operational problems force the cancellation of the tour, then no charge will be made. In all other circumstances, such as, but not limited to, sickness, delayed arrival, change of plans, you will be liable for the full cost of the pre-booked Whale Shark Tour.

Alterations

We will do our utmost to assist you if you wish to change any details on your booking, although we cannot guarantee that we will be able to make changes. We may impose an amendment fee of PHP1,000, and if you wish to make changes within 6 weeks of your intended arrival we may view this as a cancellation and our cancellation charges will apply.

Cancellations or Changes by Us

There may be some minor changes made prior to your arrival and if so we will try to advise you where appropriate before your arrival. In the unlikely event that we have to cancel or make major changes to your holiday then you can choose to accept the change or take a full refund of deposits. However, in no case will we pay compensation, and we reserve the right to cancel your holiday if we are unable to provide accommodation and meals as booked due to reason of war, threats of war, riots, civil strife, terrorist activity, industrial disputes, natural or nuclear disaster, fire, technical problems with transport, adverse weather conditions and similar events beyond our control.

Parking

Limited parking space in the resort grounds is available for guests’ vehicles, but this is not guaranteed. Drivers are not permitted access to the resort grounds except for the purposes of dropping off and picking up guests, and may not spend the night in a vehicle parked inside the resort grounds. No liability for damage to or loss of vehicles parked inside the resort will be accepted by PBCR, no matter how such damage or loss occurred.

Complaints

We greatly appreciate any comments you have on your holiday and to this end we ask for your feedback at the end of your stay. In the highly unlikely event that you do have a complaint you must first report it immediately to us specifying in writing all the relevant details. If the matter cannot be resolved whilst you are in Padre Burgos we must be notified in writing within 28 days of your departure.

Privacy Policy

All bookings and enquiries are treated with the strictest confidence, and we do not share any identifiable information about guests or people making enquiries with any third parties, except as mandated by law.
